This Privacy Policy explains how we collect, use, store, disclose and protect personal information in connection with our booking service, passenger transport operations, website and business administration.

1. Purpose and Commitment

Sydney Private Hire (SPH) respects the privacy of customers, passengers, drivers, contractors, website visitors and other persons whose personal information it handles. This policy explains how SPH collects, uses, holds, discloses, protects and manages personal information in connection with its booking service, passenger transport operations, website and business administration.

SPH is committed to handling personal information lawfully, fairly and responsibly. Where the Privacy Act 1988 (Cth) and Australian Privacy Principles (APPs) apply to SPH, SPH will comply with those requirements. SPH also applies the practical privacy controls in this policy as an internal standard where appropriate.

2. Personal Information We May Collect

Depending on the interaction, SPH may collect names, phone numbers, email addresses, pickup and destination details, booking dates and times, passenger numbers, luggage and child-restraint requirements, payment and invoice information, booking history, communications, complaints, incident information and other information reasonably necessary to provide or administer services.

For drivers, contractors or service providers, SPH may also collect identity, licence, eligibility, vehicle, insurance, compliance, training, payment and contact information required to manage the engagement and meet safety or regulatory obligations. SPH seeks to avoid collecting sensitive information unless it is reasonably necessary, authorised or required by law, or provided with appropriate consent.

3. How We Collect Personal Information

SPH generally collects information directly from the person concerned through its website, booking forms, phone, email, invoices, payment processes, customer communications and service interactions.

SPH may also receive information from a person making a booking for another passenger, an authorised representative, a driver or contractor, payment and technology providers, regulators, insurers, professional advisers or other third parties where this is lawful and reasonably necessary. A person who provides information about another individual should ensure they are authorised to do so and, where appropriate, make this policy available to that individual.

4. Why We Collect and Use Personal Information

SPH may use personal information to receive, assess, confirm and manage booking requests; provide passenger transport services; communicate about pickups, delays, payments or changes; select and assign suitable drivers and vehicles; issue quotes, invoices and receipts; process payments; provide customer service; manage complaints, incidents and lost property; maintain safety and compliance records; prevent misuse or fraud; and meet legal, insurance, tax, accounting, audit and regulatory obligations.

SPH may also use information for internal administration, service improvement, system security and legitimate business planning where this is consistent with the purpose for which the information was collected or otherwise permitted by law.

5. Disclosure of Personal Information

SPH may disclose personal information only where reasonably necessary for its operations or where authorised or required by law.

Recipients may include an assigned driver or contractor, payment processor, website or cloud service provider, accountant, insurer, professional adviser, technology support provider, regulator, law-enforcement body, emergency service or other service provider supporting the booking or business.

Only information reasonably required for the relevant purpose should be disclosed. SPH does not sell personal information to advertisers or data brokers.

6. Overseas Processing and Service Providers

SPH may use technology, website, communications, payment or cloud providers that process or store information outside Australia. Depending on the provider and its subcontractors, locations may include the United States, Ireland, Israel and other countries or regions in which the provider or its subprocessors operate.

SPH will take reasonable steps appropriate to its size and operations to select reputable providers and use available security and contractual controls. Because provider infrastructure can change, SPH cannot guarantee that every processing location will remain fixed.

7. Payment Information and Security

Card and online payments are processed through authorised payment service providers. SPH does not intentionally store complete payment-card numbers or card security codes in its ordinary booking records.

SPH may retain transaction identifiers, payment status, invoice numbers, receipt information and other records reasonably required for accounting, reconciliation, refunds, dispute management and legal compliance.

8. Booking, Safety and Record Retention

SPH retains booking and operational records for the periods required by applicable point to point transport, tax, safety and other laws and for longer where reasonably necessary for a complaint, incident, insurance claim, audit, investigation, legal hold or other legitimate business purpose.

SPH maintains an internal retention guide. Records are not retained indefinitely merely because they may be useful; SPH will securely destroy or de-identify information when it is no longer reasonably required and no legal or operational hold applies.

9. Information Security

SPH uses reasonable administrative, technical and physical safeguards appropriate to its size and systems to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Controls may include restricted access, password and account controls, reputable hosted systems, backups, device security, access review and secure disposal.

No internet, email, cloud or electronic storage system can be guaranteed to be completely secure. SPH will review its controls where a material weakness, incident or system change is identified.

10. Access and Correction

Individuals may request access to personal information SPH holds about them or ask SPH to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. SPH may ask for reasonable identity verification before providing access or making a correction.

SPH will respond within a reasonable period and may refuse or limit access where permitted or required by law. Where access or correction is refused, SPH will provide an explanation where legally appropriate.

11. Website, Cookies and Analytics

SPH websites and hosted services may use cookies, logs or similar technologies needed for site functionality, security, session management, booking functions and basic analytics. These technologies may collect device, browser, IP address, page-visit or interaction information.

Users may manage cookies through browser settings, although disabling essential cookies may affect website or booking functionality. Third-party services may operate under their own privacy terms.

12. Communications and Marketing

SPH may send transactional communications reasonably necessary to manage a booking, payment, service, complaint or safety matter. These are service communications rather than marketing.

Where SPH sends promotional or marketing communications, it will do so in accordance with applicable law and will provide a practical way to opt out where required. Opting out of marketing does not prevent necessary booking or service communications.

13. Children and Information About Minors

SPH passenger services may involve children, but the website and booking service are not intended to collect unnecessary personal information directly from children. A parent, guardian or responsible booking party should provide information required for child-restraint, passenger or safety arrangements.

SPH will handle information about minors with appropriate care and will limit collection to what is reasonably necessary for the booking, safety or legal purpose.

14. Data Breaches and Privacy Incidents

Suspected loss, unauthorised access, disclosure or misuse of personal information will be assessed promptly. SPH will take reasonable steps to contain the issue, preserve relevant evidence, reduce harm and correct identified weaknesses.

Where the Privacy Act or another law requires notification to affected individuals, the Office of the Australian Information Commissioner or another authority, SPH will make the required notification.

15. Third-Party Websites and Services

SPH may provide links to or use services supplied by third parties. SPH is not responsible for the privacy practices of an independent third-party website or service that it does not control. Customers should review the relevant provider privacy information where appropriate.

This does not affect SPH responsibilities for information that SPH itself collects, controls or discloses.

16. Privacy Questions and Complaints

Questions, access or correction requests, and privacy complaints should be directed to SPH using the contact details below. SPH will acknowledge and investigate a complaint within a reasonable period and will take appropriate corrective action where required.

If the Privacy Act applies and a person remains dissatisfied after giving SPH a reasonable opportunity to respond, they may be able to contact the Office of the Australian Information Commissioner (OAIC).

17. Changes to This Policy and Contact Details

SPH may update this policy when laws, technology providers, systems, services or business practices change. SPH maintains a controlled version of this policy and will ensure the public-facing version remains aligned with the current approved version published on the SPH website.
